2012 Legislative Update

Hello {FIRST_NAME|CRWA Member},

 

July 31st marked the end of the 2012 legislative session, and there is much to report on environmental-impacting legislation. Below are some quick recaps on current bills:

MA ENDANGERED SPECIES ACT STANDS
Great News- the MA Endangered Species Act stands! Environmental groups including CRWA fought hard against H4360 An Act Relative to Land Takings Regulations, to ensure the Endangered Species Act was not gutted and new language proposed. House Ways and Means Committee drafted a compromise bill, which would codify the regulatory mechanism under which MESA is implemented. However, enough legislators apparently feel that there are unresolved questions around how MESA is implemented that the bill did not move forward in this session.

Daly Field
DALY FIELD BILL PASSES
CRWA led the charge and formed a coalition of environmental groups to stop or defer this 11th hour legislation giving Simmons College a 30-year lease of 8.5 acres of DCR parkland to build a sports complex. Unfortunately this bill passed and now travels to Governor Patrick for a signature or veto. The bill gives the state the discretion whether to enter into the lease and CRWA will continue to demand robust public and environmental review process before any lease is signed.

Phosphorus

PHOSPHORUS FERTILIZER BILL
For the first time, a bill has been introduced to regulate phosphorus fertilizer as a source of nutrient pollution into our waterways. Though the session had now ended, CRWA believes there is a possibility the bill may be resolved in informal session.

DAM BILL FAILS TO PASS 

While the bill did not pass by the end of the legislative session, and a contentious issue about whether to include seawalls in the bill arose, there is some possibility it could still be enacted in informal session. Otherwise, CRWA hopes it will be reintroduced in the fall session.

LEGISLATIVE COMMITTEE KILLS UPDATED BOTTLE BILL

Despite unprecedented and overwhelming public support, a legislative committee recently killed the updated bottle bill by removing it from a pending jobs bill.
