COMPLIANCE CORNER

The House Energy and Commerce Committee recently approved two new bills requiring companies holding personal information to adopt appropriate measures to protect against security breaches, and to warn consumers about potential dangers in downloading peer-to-peer software.  These bills are designed to protect against inadvertent sharing of sensitive information such as tax returns, medical files, or classified government documents, through use or misuse of file sharing networks.  Installers of such software are required to notify computer users that software is to be installed, allow the consumer to opt out or to uninstall, and notify the consumer within 60 days of any private data breach.  The FTC may enforce this legislation with penalties up to $5 million for violations.
