New Dietary Supplement Enforcement Act Holds FDA Accountable for Enforcing DSHEA Over Industry On May 25, 2010, Senators Tom Harkin (D-IA) and Orrin Hatch (R-UT) introduced a new bill to Congress and Senate entitled "Dietary Supplement Full Implementation and Enforcement Act of 2010." The new Act seeks to strengthen the Food and Drug Administration's (FDA) authority to enforce the 1994 Dietary Supplement Health Education Act (DSHEA) over dietary supplements. This Act comes just two months after congressional leaders introduced the "Free Speech about Science Act" that sought to allow the free distribution of legitimate scientific research to the public about dietary supplements and foods. According to the senators, this new bill will make sure that the FDA is held accountable for its authority over the industry. Marketing Opinion Blog - FTC's "New Powers" Over Dietary Supplement Advertising & Substantiation: Truth or Hype? Recently, there's been a sweeping allegation reported on various blogs about the provisions made in the new financial reform bill granting the Federal Trade Commission (FTC) with new, more expanded authority over the dietary supplement and food industries. These sources claim that the FTC would be given new powers by the federal government to make new regulations over dietary supplement/food advertising without congressional pre-approval...However, according to my own review of the bill, the allegation of FTC's more powerful, dictatorial-type rule over our industry is nothing but hype. |
