INCREASE IN PENALTIES

The maximum penalty for each breach of the Fair Work Act 2009 has risen to $54,000.  This increase has wide effect, as there is a growing trend in adverse action claims to prosecute all of the people "involved" in any contravention, in addition to the company. This may include the human resources manager, line manager, general counsel, or a director or officer of the company.

7-ELEVEN OPERATOR FACES COURT FOR UNDERPAYMENTS

The Fair Work Ombudsman has commenced legal proceedings against a 7-Eleven retail store in Sydney which allegedly underpaid two migrant employees almost $50,000 and created erroneous records for the workers.

7-Eleven Store

The owner faces maximum penalties of between $5100 and $10,200 per breach and his company $25,500 to $51,000 per breach.
