Credit Reports for Employment: What are your Obligations as Employers?

The use of credit reports in hiring has increasingly been scrutinized.  The EEOC recently issued an advisory letter on the use of Credit Checks as employee selection criteria.  Just hours later, Governor Kulongoski of Oregon signed legislation prohibiting employers from using credit history in making hiring, discharge, promotion and compensation decisions unless the employee/applicant is given advanced written notice and the information is significant to the position.  

 

For many employers, a Credit History Report is a commonly requested element of their background check program, allowing them to measure the level of responsibility of each applicant.  What do these laws mean to you?  What are your obligations and how will you be affected?
