Disclosure and Barring Service (DBS)

UPDATE 11
th June 2013


Following my Newsletter no 10 of 23rd May2013, please now note these updates following receipt of further information from the DBS, and separately from the Church of England.

1     THE NEW DBS ONLINE UPDATE SERVICE

Although from 17 June 2013 applicants can subscribe to the Update Service with a new application or new Certificate, the contract for the online update service has already been reallocated to a different company from 1st October 2013. The advice of the Church of England to dioceses is that we make no steps towards using this service until after the first months of teething problems and the changeover of IT company.

Please therefore do not ask anyone in the diocese to register for this service until 1st November 2013 at the earliest.



2     APPLICANT ONLY DBS CERTIFICATES (AKA the SINGLE CERTIFICATE)

From 17th June, the DBS will no longer issue a copy of the applicant’s DBS certificate to the Registered Body, i.e. Peterborough Diocese. The headline guidance  for our churches from the Church of England is as follows:

For all engaged in Parish roles including renewals:

    All those who receive their criminal record disclosure are asked to show the disclosure to the Incumbent or Parish Safeguarding Officer (PSO) or Rural Dean. Those with clear criminal record disclosures (i.e. absolutely no information upon them beyond the address and role applied for) can be cleared for work/volunteering. The Incumbent or PSO or Rural Dean should then notify Sharon Welbourne, Senior Secretary by email or telephone of the name of the name of the person, date of clearance and the disclosure number on the enhanced certificate.

    For all who hold a Bishop’s license (clergy and lay) the PSO or Incumbent or Rural Dean should notify Alex Low Bishop’s PA by email or telephone with the name of the person, date of clearance and the disclosure number on the enhanced certificate.

    Criminal record disclosures with any information on at all should be copied and sent through to Garry Johnson, Diocesan Safeguarding Officer. The envelope should be marked “strictly private and confidential” and sent to:

3   COMPLETING and CHECKING THE DBS APPLICATION FORM

Verifiers: (ie the Incumbent/PSO/Rural Dean )

In addition to including one of the following phrases in field x61, line 1 (as advised in Newsletter no 10, May 2013

•    Child Workforce  use this for any position that involves working/volunteering with children

•    Adult Workforce  use this for any position that involves working/volunteering with adults

•    Child and Adult Workforce use this for any position that involves working/volunteering with children and adults

•    Other Workforce use this for any position that does not involve working/volunteering  with children and adults

… you are now asked in field  X61 Line 2 to enter a description of the ‘Position Applied For’ (up to 30 characters).



4     REMOVAL OF CERTAIN SPECIFIED OLD AND MINOR OFFENCES FROM CRIMINAL RECORD CERTIFICATES

On 29 May 2013, the DBS removed certain specified old and minor offences from criminal record certificates issued from this date. (Changes to the legislation introduced on the 29 May 2013 allowed the DBS to do this.) The filtering rules, together with the list of offences that will never be filtered, are available from www.gov.uk/dbs.

In line with these changes, the DBS have amended Question e55 on the application form. To ensure the law is followed correctly, Registered Bodies (ie Peterborough Diocese) are required to make the following change to the application form. Will Incumbents, PSO’s and Rural Deans please advise applicants of the following:

Question e55 asks the applicant:

‘have you ever been convicted of a criminal offence or received a caution, reprimand or warning?’

Applicants should now  ignore this question and instead treat this question as if they are being asked: ‘do you have any unspent convictions, cautions, reprimands or warnings?’

The Guidance on DBS checks on the Peterborough diocesan website is amended accordingly
.
